CONSULTANCY SERVICES

The Manomay CFSC Special Valuation Branch of customs handles cases related to transactions between associated parties and adheres to the procedures outlined in the circulars issued by CBEC periodically. This process entails a thorough investigation that spans a significant duration and requires the importer to respond to a series of questionnaires while maintaining comprehensive documentation and providing information as needed. Following the investigation, customs will either accept or reject the declared value. In cases of rejection, the value is recalculated using a sequential methodology, which includes identical/similar valuation, deductive valuation, computed valuation, and residual valuation. Occasionally, this reevaluation may lead to the imposition of fines and penalties, depending on the reasons for the value rejection.

VALUATION

Most import duties and export incentives are determined by the value of the goods being imported or exported. The valuation process follows customs guidelines, which are governed by:

Typically, the declared transaction value is accepted as the value of the goods, except in specific circumstances. However, customs may reject the declared value for several reasons, including:

Significantly higher values of comparable identical or similar goods imported around the same time
Abnormal or specific discounts
Mis-declaration or non-declaration of required parameters

Customs evaluates the goods and their declared value presented by the importer. Once assessed, the goods are cleared for release upon the payment of duties.
