
About
‘A’, an overseas seller supplies goods to ‘B’ an overseas buyer. Once after completion of necessary export procedures, A submits all necessary documents to his bank at seller’s place.
‘B’, enters in to an agreement of sale with C under high sea sale, once after movement of goods from the territorial border of exporter but before arrival of goods at the territorial border of India.
B accepts documents from his bank which has been sent by A through his bank. If the payment terms with A and B are on sight LC or DP, B remits invoice value of goods to A before collecting documents from bank. Incase of credit arrangements with A, B remits invoice value of goods to A as per the arranged credit period. The Bill of Lading (or airway bill) is endorsed by B and transfers the title of goods in favor of C.
B prepares invoice to C in local currency ( INR ). B delivers endorsed original Bill of lading (or airway bill), his invoice in local currency along with import invoice, packing list, certificate of origin, insurance certificate and other necessary documents if any for import clearance duly endorsed. A retains a copy of all documents which he delivers to C.
C files Bill of entry along with other import documents delivered by A with customs authorities. C pays necessary import customs clearance charges with import duty if any. B can also under take customs clearance and delivery to C, if B does not want to know the actual contract price of A and B. In this case, B is filing documents on behalf of C to hide the selling price between A and B.
Once after completion of import customs clearance procedures, C delivers a copy of bill of entry to B. B files the said bill of entry and other copies of import documents and high sea sale documents with his bank.
Apart from document needed for regular import consignment below documents are also needed for high sea sales
Documents Needed :
1. Buyers Confirmation letter confirming that the Consignment has been bought on HSS.
2. Seller Confirmation Letter confirming that the consignment has been sold on HSS.
3. High Seas Sale Agreement on Rs. 200/ stamp Paper duly notarised. (notary should be done from the same local advocate from where the agreement is prepared)
4. Commercial Invoice in foreign currency
5. Local Invoice in INR.
[P.N : The same person who is signing the buyer/ seller letter has to sign the agreement. Date of the HSS Agreement has to be between the BL date and arrival date of the shipment.]
RE-IMPORT
EXPORT DOCUMENTS :
1. Shipping Bill ,E.P copy in Original
2. Export Invoice and Packing List custom attested.
3. ARE 1 in Original Custom attested (ARE No.003 dt. 06.08.2014
4. Reason for goods return letter from the supplier.
5. Mate Receipt.
6. B/L copy self attested.
7. Freight Bill (Export) from shipper company.
IMPORT DOCUMENTS :
Import Invoice / Packing List/BL/Other regular import documents
POINTS TO BE NOTED :
1. The identity of the goods should be established with export documents.
2. It has to be mentioned that goods are returned after rejection on the Import Invoice.
(A) As per public notice 21/2010 amended via public notice 10/2014.
1. Copy of VAT/Sales Tax/Central Excise/Service Tax Registration Certificate.
2. Certificate from the Bank with whom the Bank account is being maintained by the importer certifying the signatures, name and address of the importer.
3. Proof of payment / remittance through the importers account.
4. Balance sheet of the previous year.
5. Copy of the last Income Tax Return / VAT or Sales Tax Return filed/Central Excise Return /Service Tax Return filed.
Apart from the above, the documents required by us for Custom Clearance are mentioned below:
1. IEC copy.
2. Company’s PAN copy.
3. Company registration certificate.
4. VAT/sales tax/ central excise reg. certificate.
5. Authority letter to us for clearing the consignment.
6. 3-4 copies of your letter head.
EXPORT DOCUMENTS :
1. Import BL, Invoice & Packing List (self attested).
2. Import Original BOE & Duty Paid Challan Copy(self attested).
3. Export Invoice & Packing List with duly mentioning import details.
4. GR Form.
5. CE Certificate (Value purpose).
6. Bank Details (Drawback purpose).
7. Explanation Letter for returning of goods.
8. Export Declaration Form.
Export Promotion Capital Goods (EPCG) scheme allows import of capital goods including spares for pre production, production and post production at zero duty subject to an export obligation of 6 times of duty saved on capital goods imported under EPCG scheme, to be fulfilled in 6 years reckoned from Authorization issue date.

LIST OF DOCUMENTS REQUIRED UNDER EPCG
1.Application letter for EPCG registration .The applicant has to give a bond and bank guarantee for license (both formats attached)
2.Central Excise Certificate of Manufacturer Exporter (Original or attested by Central Excise).
3.Pan copy attested by you.
4.IEC copy attested by you.
5.Power of Attorney of the person signing the bonds and other documents.
Please note the BG is waived if the license holder fulfils any of the below conditions:
1. Status Holder: In this case the applicant has to provide original/Notarised status holder certificate.
OR
2.Paid above One Crore rupees of Excise Duty in the preceding year : In this case the applicant has to provide with a Central Excise certificate stating that the applicant has paid more the One Crore Rupees of excise duty in the preceding year.
If the applicant does not fall in above categories then he has to give a BG (15% in case of manufacturer exporters)
DEEC is and export promotion scheme, which enables duty free import of inputs required for manufacture of export goods. Advance licences are issued by DGFT to manufacturer/ merchant exporter (having supporting manufacturer) under DEEC scheme for import of inputs at nil rate of CVD also. Value and Quantity of each item permitted under DEEC imports are specified in the Advance Licence.
LIST OF DOCUMENTS NEEDED.
1.Original license with all annexures and forwarding letter with self attested copy of importer exporter code.
2. Covering letter addressed to the deputy commissioner of customs, requesting for registration at relevant ports and authorizing to CHA present the documents on importers behalf.
3. Bond under notification (updated) duly attested by the notary and signature/s attested by the bank. With self attested photo address proof of both witnesses (photo address proof like driving license, voter’s id, passport.
4. Bank guarantee if party does not have export house/star export house /super star export house or turnover certificate attested by the range excise authorities.
5. Self attested copy of complete application submitted to DGFT for the issuance of relevant license.
6. Calculation sheet/schedule attached with bond.
7. Self declaration on Rs. 100 stamp paper attested by notary about non-penalization by customs for non-compliance with export obligations with respect to the licenses issued earlier.
8. Self attested copy of company’s memorandum/partnership deed .in case of Pvt. Ltd./Ltd Co., company board resolution authorizing the signatory for executing the relevant documents
